The ability of foreign nationals to purchase real estate from Turkey is regulated in Articles 35 and 36 of the Land Registry Law No. 2644. In order to buy immovable property, it is not necessary to have a residence permit in Turkey. In other words, you can buy immovable property even if you do not have a residence permit. As a result of the recent developments in the Middle East, our country hosts many foreign citizens. With the legalization of granting Turkish citizenship to foreigners who buy real estate in Turkey for at least $250,000 or invest $500,000 or more, their demands for owning a house in Turkey are increasing day by day.

According to the current legislation in Turkey, official contracts aiming at the transfer of immovable property must be made at the Land Registry Offices where the immovable is located. In addition, it is possible to sign a “preliminary sales contract” in the presence of a notary public before the official sale.

– Legal restrictions on acquisition of real estate by foreigners :

* Foreigners can purchase real estate to be used as a workplace or residence in Turkey, provided that they comply with legal restrictions. However, even in different cities, the total area of ​​immovables that a foreign person can purchase in Turkey cannot exceed 30 hectares.

* It is also necessary to obtain permission from the military authorities in the region before foreigners purchase real estate. If the said real estate is located within the security zone, it is important to clarify this issue before making the payment, as it will not be possible to sell to foreigners.

DOCUMENTS AND INFORMATION REQUIRED WHEN BUYING IMMOVABLE PROPERTY

Identity documents or passports,

* Residence permits issued by the relevant police directorates for foreigners whose immovable acquisitions are subject to a residence permit,

* In case they take action by proxy based on the power of attorney issued from abroad, they are required to keep the original or a certified copy of the power of attorney together with their translation.

Before making sales contracts, matters such as whether the immovable is registered with limited real rights, whether there is a mortgage or any situation that prevents its sale, should be checked from the relevant Land Registry Office.</p >

– Issues that foreigners should pay attention to in the acquisition of real estate; 

* It should be learned whether the house to be purchased has a mortgage or foreclosure that prevents the sale. This information can be obtained from the General Directorate of Land Registry and Cadastre.

*  An agreement should be made with an intermediary firm whose reliability is assured.

*  In case of disagreement between the parties regarding the sale of real estate, a lawsuit should be filed in the courts of the Republic of Turkey.

*  Making a preliminary sales contract in the presence of a notary public is not sufficient for sales. Official transactions should be carried out at the land registry offices.

*  The title deed fee to be paid in house purchases is paid by the buyer and the real estate owner.
