What is Family Residence Permit?

A family residence permit is a type of permit that allows a foreign individual to stay in Turkey with their family. It is governed by Articles 34 to 37 of the Law on Foreigners and International Protection, as well as Articles 30 to 34 of the Regulation on the Implementation of the Law on Foreigners and International Protection. These laws and regulations set out the requirements for obtaining a family residence permit, as well as the rights and obligations of individuals who hold such a permit.

Who are the foreigners who can be issued a Family Residence Permit?

Turkish citizens, those who are within the scope of Article 28 of Law No. 5901 or foreigners who have one of the residence permits, refugees and subsidiary protection status holders;

  1. To his foreign spouse,
  2. To the minor foreign child of himself or his spouse,
  3. The dependent foreign child of himself or his spouse,

family residence permit can be issued.

Children’s family residence permit requests must be given the consent of the parents who have joint custody, if any.

Family residence permit provides the right to education in primary and secondary education institutions until the age of eighteen without obtaining a student residence permit.

Foreigners with a family residence permit may request a short-term residence permit in the following cases:

  • In case of divorce, if she is married to a Turkish citizen and has stayed with a family residence permit for at least three years, (However, foreigners who prove that they are victims of domestic violence with a court decision are not required to have stayed with a family residence permit for at least three years.)
  • If the sponsor’s family stays in our country with a residence permit in case the sponsor dies,
  • If those who have stayed in our country with a family residence permit for at least three years have completed the age of eighteen.

For How Many Years Can Family Residence Permit Be Issued?

– Family residence permit can be issued for a period not exceeding three years at a time.

– The duration of the family residence permit may never exceed the duration of the sponsor’s residence permit.

What are the Conditions of Family Residence Permit?

For a family residence permit to be issued, foreigners must meet the conditions set forth in Article 35 of the Law.

  • To meet the requirements of the sponsor,

(The sponsor must have valid health insurance covering all family members, have a monthly income not less than one third of the minimum wage per person, certify that he has not committed a crime against family order in the last five years, certify with his criminal record that he has resided in Turkey for at least one year. and registered to the address registration system)

  • To meet the requirements for those who apply for a family residence permit to stay with the sponsor,

(Submitting supporting information and documents regarding the purpose of staying in our country, demonstrating that he/she lives or intends to live with the specified persons, spouses have completed the age of eighteen, are not within the scope of Article 7 of the aforementioned Law, the marriage has not been made for the purpose of obtaining a family residence permit)

What are the Reasons for Refusal, Cancellation or Non-Extension of Family Residence Permit?

  • The conditions for family residence permit are not fulfilled or disappeared,
  • It is determined that the family residence permit is used for purposes other than its issuance,
  • The presence of a valid deportation or entry ban decision,

In cases of the family residence permit is not granted, if it is given it is canceled, the ones whose period has expired are not extended.

What are the Required Documents for Family Residence Permit?

Requirements for Family Residence Permit (Common)

  1. Residence Permit Application Form (signed by the applicant or their legal representative)
  2. Copy of passport or document replacing passport (pages showing identification and photo, as well as entry and exit stamps and visa information) (original must be presented on the day of the appointment)
  3. Four (4) biometric photos (taken within the past 6 months, with a white background and biometric specifications)
  4. Documents/receipts showing payment of the residence permit fee and card fee
  5. Copy of marriage certificate or document proving marriage (pages showing information – first 3 pages) (original must be presented on the day of the appointment) (if obtained from Turkish authorities (District Population Directorates), must be e-signed/signed and sealed/stamped, if obtained from abroad, must be accompanied by a notarized Turkish translation and an Apostille stamp. If the applicant is from a country that is not a party to the Apostille Convention or the document does not have an Apostille stamp, the document must be approved by the relevant authorities in that country (consulate/embassy approval and the Ministry of Foreign Affairs/authorized Turkish authorities).

For Children of the Applicant (Minor Children or Children for Whom the Applicant is Responsible) In addition to the Common Documents, the following documents are required:

  1. Birth certificate if parentage cannot be determined from the passport or national identification cards of the parents
  2. In case of divorce, a court-approved custody decree or consent letter from the other parent in case of joint custody
  3. In case of the death of one parent, the court-approved death certificate of the parent (If these documents are obtained from Turkish authorities, they must be e-signed/signed and sealed/stamped. If obtained from abroad, they must be accompanied by a notarized Turkish translation and an Apostille stamp. If the applicant is from a country that is not a party to the Apostille Convention or the document does not have an Apostille stamp, the document must be approved by the relevant authorities in that country (consulate/embassy approval and the Ministry of Foreign Affairs/authorized Turkish authorities).)

Documents are required from the sponsor:

  1. Turkish citizen:
    • Original and photocopy of ID card/residence permit (original must be presented on the appointment day)

Foreign citizen:

    • Photocopy of passport or equivalent document (showing identity information and photograph, as well as entry and exit stamps and visa information) (for refugees and holders of secondary protection status, if applicable) (original must be presented on the appointment day)
    • Photocopy of residence/work permit, blue card, refugee or secondary protection status ID documents (original must be presented on the appointment day)
  1. Certified, e-signed/signed document indicating sufficient and regular financial means for the intended duration of stay
  2. Health insurance covering all family members (the insurance period must cover the requested residence permit period. Any of the following will be sufficient):
  3. Criminal record
    • If not resident in Turkey for the past 5 years: criminal record from their own country authorities (it is advisable to request this document at least 3 months before the application, in case obtaining it takes a long time) or criminal record from Turkish authorities (if resident in Turkey for the past 5 years)
    • If not available: sworn declaration stating that the applicant has no criminal record
  4. Document showing that you are registered in the Address Registration System  (If you are registered in the address registration system) “Residence Certificate” obtained from the district population directorates with e-signature/signed and stamped/sealed or from the e-government system (www.turkiye.gov.tr) (In the case of the supporter being a Turkish citizen, the “Valid Population Registration Sample” is also accepted.)
  5. Document showing the place of residence (One of the following is considered sufficient.)
    • If you are staying in your own house, a copy of the title deed;
    • If you are staying with a rental contract, a notarized copy of your rental contract;
    • If you are staying with a third person, a notarized undertaking of the person you are staying with (In the case of the person you are staying with being married, a notarized undertaking of the spouse is also required.)

A copy of the previous residence permit document is included in the application documents (The original of the document is submitted to the administration on the appointment day.)
