Can Children Born in Turkey Become Turkish Citizens?

Understanding Turkish Citizenship by Birth

Turkish citizenship laws are primarily based on the principle of lineage (jus sanguinis). This means that a child usually acquires citizenship through their parents, not simply because they were born on Turkish soil. Under Turkish Citizenship Law No. 5901, birth in Turkey does not automatically grant a child the right to a Turkish passport if the parents are both foreigners.

However, there are specific conditions where a child can become a citizen at birth. These rules ensure that children with Turkish parents are protected and that no child born in Turkey remains stateless.

Citizenship Through Lineage (Jus Sanguinis)

Lineage is the most common way to acquire Turkish citizenship. If at least one parent is a Turkish citizen at the time of birth, the child is automatically a Turkish citizen. This applies regardless of whether the child is born in Turkey or abroad.

Children Born Within a Marriage

A child born to a Turkish mother or a Turkish father within a legal marriage union is a Turkish citizen from the moment of birth. It does not matter if one parent is a foreign national. The Turkish lineage of one parent is sufficient for the child to receive citizenship.

Children Born Outside of Marriage

The rules for children born out of wedlock depend on which parent is the Turkish citizen:

  • Turkish Mother: If the mother is a Turkish citizen, the child is automatically a Turkish citizen at birth.
  • Turkish Father: If the father is a Turkish citizen and the mother is a foreigner, the child acquires citizenship only after legal lineage is established. This happens through the recognition of paternity or a court decision confirming the father's identity.

Citizenship Through Place of Birth (Jus Soli)

Turkey does not grant "birthright citizenship" in the same way as countries like the United States. However, Article 8 of Law No. 5901 provides an exception to prevent statelessness. A child born in Turkey may acquire Turkish citizenship if they cannot obtain citizenship from any other country through their parents.

Preventing Statelessness

If a child is born in Turkey to foreign parents who cannot pass their own citizenship to the child, Turkey grants that child citizenship. This ensures the child is not left without a legal nationality. Additionally, any child found in Turkey is presumed to have been born in Turkey and is considered a Turkish citizen unless proven otherwise.

Common Misconceptions for Foreign Parents

Many foreign nationals believe that giving birth in Turkey provides an easy path to citizenship for the child or the parents. This is a misconception. If both parents are foreign citizens (for example, two Russian or two British citizens), their child will not become a Turkish citizen just by being born in a Turkish hospital. The child will typically take the nationality of the parents.

The birth of a child in Turkey also does not grant the parents an automatic right to Turkish citizenship. Parents must still meet the standard legal requirements for naturalization, such as residency duration or investment, if they wish to become citizens themselves.

How to Register a Birth in Turkey

All births in Turkey must be reported to the Civil Registration Office (Nüfus Müdürlüğü). For children of Turkish citizens, this registration officially records their citizenship. For foreign parents, the registration provides a birth certificate, which is necessary to obtain a passport for the child from the parents' home country embassy or consulate.

Registration should ideally happen within 30 days of the birth. If the birth occurs abroad to Turkish parents, it must be reported to the nearest Turkish consulate within 60 days.
