Can Children Born in Turkey Become Turkish Citizens?
Discover the legal requirements for children born in Turkey to foreign parents and learn if your child is eligible for Turkish citizenship under Law No. 5901.
Understanding Turkish Citizenship by Birth
You might think being born in Turkey makes a child a citizen automatically. But Turkish citizenship by birth works differently than in the US or Canada. It's mostly about who your parents are, not where the hospital is. Under Law No. 5901, birth on Turkish soil doesn't give a child a Turkish passport if both parents are foreigners.
There are still ways for a child to get citizenship at birth. These rules protect children with Turkish parents. They also make sure no child born here ends up without a country.
Citizenship Through Lineage (Jus Sanguinis)
Lineage is the most common way to get Turkish citizenship. If at least one parent is a Turkish citizen when the child is born, the child is Turkish too. This rule applies whether the birth happens in Turkey or anywhere else in the world.
Children Born Within a Marriage
Is one parent Turkish? If the parents are legally married, the child is a citizen from day one. It doesn't matter if the other parent is a foreign national. One Turkish parent is all it takes for the child to get their rights.
Children Born Outside of Marriage
Rules for children born out of wedlock depend on which parent is Turkish. If the mother is Turkish, the child is a citizen at birth. But if only the father is Turkish, you must establish a legal link. This usually happens through paternity recognition or a court decision.
Citizenship Through Place of Birth (Jus Soli)
Turkey doesn't offer "birthright citizenship" to everyone. However, Article 8 of the law helps children who might face statelessness. A child born here can get citizenship if they can't get it from any other country through their parents.
Preventing Statelessness
Sometimes foreign parents can't pass their nationality to their kids. In these cases, Turkey grants the child citizenship. This ensures the child has a legal home. Also, any child found in Turkey is presumed to be born here and is considered a citizen unless proven otherwise.
Common Misconceptions for Foreign Parents
Many people think giving birth here is a shortcut to citizenship for the family. That's not how it works. If two British parents have a baby in Turkey, the baby is British. The birth doesn't give the parents any special rights to stay or get a passport.
Parents still have to follow the normal path to become citizens. You might need to live here for a long time or make a large investment. Don't expect the birth alone to change your legal status.
How to Register a Birth in Turkey
You must report all births to the Civil Registration Office (Nüfus Müdürlüğü). For Turkish parents, this records the child's citizenship. For foreign parents, you'll get a birth certificate. You need this paper to get a passport for your child from your own embassy.

So, try to register the birth within 30 days. If you're a Turkish citizen living abroad, you have 60 days to tell the nearest consulate. Following these steps ensures your child has the right papers for their Turkish citizenship by birth or their foreign passport.
