Legal Requirements for Moroccan-Turkish Marriages

Marrying a Moroccan citizen involves specific legal steps that vary depending on whether the ceremony takes place in Turkey or Morocco. Both countries require strict documentation to ensure the marriage is legally recognized in both jurisdictions. Failure to follow these procedures can lead to delays or the marriage being declared invalid in one of the countries.

Moroccan Citizens Marrying in Turkey

For a Moroccan national to marry in Turkey, they must generally hold a valid residence permit. The most critical document required is the Certificate of Celibacy (Unmarried Status). This document must be obtained from the Moroccan Consulate in Turkey. It proves that the individual is legally free to marry. Once this certificate is obtained, it must be legalized by the local District Governorship (Kaymakamlık) in Turkey before the marriage application can proceed at the local marriage office (Evlendirme Dairesi).

Turkish Citizens Marrying in Morocco: Required Documents

Turkish citizens planning to marry in Morocco must prepare a comprehensive dossier. Since January 3, 2022, all documents must meet specific translation and certification standards. Moroccan authorities do not accept documents from Turkey that lack an "Apostille" certification.

Essential Document List for Turkish Citizens

  • Passport and T.R. ID Card: Original documents and photocopies.
  • Birth Certificate: A certified copy from the Population Directorate. It must be translated into Arabic and Apostilled.
  • Criminal Record: Obtained from the courthouse. It must be translated into Arabic and Apostilled. The Turkish Embassy can also issue this in Arabic.
  • Income Certificate: A signed and approved document from your employer showing your financial status. This must be translated into Arabic and Apostilled. The Embassy cannot issue this document.
  • Residence Certificate: Obtained from the Population Directorate or Muhtar's office. It requires an Arabic translation and an Apostille.
  • Divorce Decree: If applicable, the final court decision must be translated into Arabic and Apostilled.

Documents Required for the Moroccan Spouse

The Moroccan partner must also provide specific documents to the Turkish Embassy if the marriage is being processed through Turkish diplomatic channels in Morocco:

  • Original Certificate of Celibacy: Must be Apostilled by Moroccan authorities and translated into Turkish.
  • Moroccan National ID: Original and photocopy.
  • Birth Registration: An official sample Apostilled by Moroccan authorities with a Turkish translation.
  • Divorce Certificate: If the spouse was previously married, the original court decision must be Apostilled and translated.

The Apostille and Translation Process

Accuracy in translation is vital. As of 2022, all translations performed in Morocco must be done by sworn translators registered with the Turkish Embassy. Documents brought from Turkey must be Apostilled at the District Governorship (Kaymakamlık) or the relevant Governor's office before they are sent abroad. Without the Apostille stamp, Moroccan authorities will reject the paperwork immediately.

How to Register a Moroccan Marriage in Turkey

A marriage performed before Moroccan authorities is not automatically recorded in the Turkish population system. You must register it manually. Follow these steps:

  1. Obtain the original Arabic marriage certificate.
  2. Have the certificate certified by the Moroccan Ministry of Foreign Affairs.
  3. Get a Turkish translation from a sworn translator registered at the Turkish Embassy.
  4. Submit the original certified document and the translation to the Consular Branch of the Turkish Embassy.

Both parties should apply in person. The Embassy will then process the registration, ensuring the marriage is legally recognized in Turkey.
