Discover the legal regulations regarding entry bans for children under 18 in Turkey and learn how to resolve visa violations to ensure a smooth return to the country.
Entry Ban Regulations for Minors in Turkey
Foreigners who overstay their visa or residence permit in Turkey usually face an entry ban. However, the rules for children under the age of 18 differ significantly from those for adults. Since June 2020, Turkey has implemented more lenient policies for minors to ensure they can maintain their legal status without long-term penalties.
The June 2020 Regulation Change
Before June 2020, children were often subject to the same entry bans as adults. Under current regulations, children under 18 who violate visa rules are not banned from entering Turkey, provided they follow the correct exit procedure. This change helps families stay together and allows minors to rectify their legal status quickly.
How to Prevent an Entry Ban for a Child
To avoid a ban, the child must leave Turkey voluntarily. At the airport or border gate, the parents or legal guardians must pay the administrative fine calculated for the overstay period. If this fine is paid upon exit, the child will not receive an entry prohibition. They can return to Turkey as soon as they wish, following standard visa rules.
Calculating the Overstay Fine
The fine amount depends on the child's nationality and the length of the overstay. It is calculated by the provincial migration management or border authorities. Paying this fine is the most critical step in ensuring the child's future travel to Turkey remains unrestricted.
Re-entering Turkey and Obtaining a Residence Permit
Once the child has exited and the fine is paid, they can re-enter Turkey. Upon re-entry, the child can enter under a visa-free regime (if applicable) or with a valid visa. Once back in the country, the family should immediately apply for a residence permit to ensure the child remains legal.
Conditional Entry (V-84)
In some cases, foreigners who have overstayed are allowed to enter under a "conditional entry" status. This requires a commitment to apply for a residence permit within 10 days of arrival. This pathway is often used by families to legalize their children's stay quickly after an overstay situation.
What Happens if the Fine is Not Paid?
If a minor leaves Turkey after an overstay without paying the required administrative fine, an entry ban will be issued. The duration of this ban depends on the length of the violation. To lift this ban, the fine must usually be paid at a Turkish consulate abroad or upon a future attempt to enter, though the ban itself may still remain active for a set period.
Key Steps for Parents
- Check the exact overstay duration for your child.
- Visit the Violation Desk (İhlalli Giriş-Çıkış Ofisi) at the airport before your flight.
- Pay the calculated fine in full.
- Keep the payment receipt for future reference.
- Re-enter Turkey legally and apply for a residence permit within the required timeframe.
