Minimum Residence Permit Duration for Domestic Applications
To apply for a Turkish work permit from within Turkey, a foreigner must hold a valid residence permit with at least six months of remaining validity. This six-month period is the minimum threshold required by the Ministry of Labor and Social Security for domestic applications. If you do not meet this requirement, you must initiate the application through a Turkish consulate in your country of origin or legal residence.
Domestic vs. International Work Permit Routes
Foreigners have two primary paths to obtain a work permit in Turkey. The domestic application is generally faster and more convenient as it does not require a visa appointment at a consulate. However, it is strictly reserved for those who already possess a long-term residence permit. Short-term permits, such as those issued for tourism, often serve as the basis for this transition, provided they meet the six-month validity rule. If the residence permit was issued for less than six months or is nearing expiry, the applicant must follow the international route.
Mandatory Documents for the Foreign Applicant
The application process is handled electronically through the e-permit automation system. The applicant must provide the following documents:
- Employment Contract: A formal agreement signed by both the employer and the foreign employee. This document must be scanned and uploaded during the digital application.
- Passport Copy: A clear scan of the passport. If the passport uses non-Latin characters, a certified translation by a sworn translator or official authority is required.
- Educational Certificates: A copy of the diploma or temporary graduation certificate. This must be translated into Turkish and notarized. For domestic worker applications (such as babysitters or caregivers), a formal diploma is not mandatory; a statement regarding the last school completed is sufficient.
Required Documentation for the Employer
The Turkish company hiring the foreigner must also submit specific financial and legal documents to prove the business's legitimacy and capacity to pay wages:
- Turkish Trade Registry Gazette: This document must show the current capital and partnership structure of the organization.
- Financial Statements: The balance sheet and profit/loss statement for the most recent year. These must be approved by the tax office or a certified public accountant (SMMM).
Critical Passport Validity Rules
According to Article 23 of Law No. 6458, work permits are issued based on passport validity. A work permit will not be granted for a period exceeding 60 days before the passport's expiration date. Furthermore, if a passport has less than 60 days of validity remaining at the time of application, the Ministry will not process the request. Always ensure your passport is valid for at least one to two years before starting the process to avoid shortened permit durations.
The E-Permit Application Process
Once all documents are gathered, the employer or an authorized intermediary submits the application online. The system requires an electronic signature (e-imza) from the Turkish employer. After the online submission, the Ministry reviews the file. If approved, the work permit card is mailed to the employer's address. This card also serves as a residence permit, meaning the individual no longer needs a separate residence card while the work permit remains valid.
