Understanding the Invitation to Leave Turkey (Terke Davet)
Foreigners who violate their legal right to stay in Turkey face administrative sanctions. These violations include overstaying a visa, visa exemption, residence permit, or work permit. Under the Law on Foreigners and International Protection No. 6458, specifically Article 9, the Turkish government provides a mechanism for certain violators to leave the country without facing a long-term entry ban. This process is often referred to as an "invitation to leave."
Conditions for Avoiding an Entry Ban
Turkey applies specific principles to determine whether a foreigner should be banned from re-entering the country. If you have violated your stay but follow the legal exit procedures, you may avoid an entry ban entirely. The following conditions must be met:
1. Violation Duration Under Three Months
Foreigners who have overstayed their legal right to stay for less than three months (excluding exactly three months) can avoid a ban. To qualify, the individual must voluntarily go to the border gates to exit the country before they are detected by authorities or within the time frame granted by an invitation to leave.
2. Compliance with the Departure Period
When authorities issue a deportation decision, they may grant a period of 7 to 30 days for the foreigner to leave Turkey. This is the "invitation to leave." If the foreigner arrives at the border gate within this allotted time, they are considered to be in compliance with the law.
3. Payment of Administrative Fines
Compliance is not just about leaving on time. Foreigners must pay the administrative fines calculated under the Law on Fees No. 492. These fines are based on the duration of the overstay and the nationality of the individual. Payment must be made at the designated desks at airports or land borders before exiting.
Entry Ban Principles Under Article 9
Article 9 of Law No. 6458 outlines the framework for entry bans. If a foreigner meets the criteria mentioned above—leaving within the time limit and paying all fines—no entry ban decision is taken. This allows the individual to apply for a new visa or enter Turkey again under general regulations immediately.
Consequences of Non-Compliance
Failure to follow the invitation to leave or failure to pay the administrative fines results in stricter penalties. If a foreigner does not leave within the granted period or refuses to pay the fine, an entry ban will be issued. The duration of this ban typically ranges from 1 month to 5 years, depending on the length of the initial violation and the nature of the non-compliance.
How to Handle an Overstay Situation
If you realize you have overstayed your visa or permit in Turkey, do not wait for the police to find you. Voluntarily proceeding to the airport or border gate is the best way to maintain your right to return. Ensure you have sufficient cash to pay the fine at the border, as credit card payments are not always available at every customs point. Once the fine is paid and the exit is stamped, your record remains clear for future travel, provided you do not have other legal issues.
The Role of the Migration Administration
The Presidency of Migration Management (PMM) oversees these procedures. They provide the official calculations for fines and manage the entry/exit records. It is important to stay updated with their official announcements, as regulations regarding specific nationalities or fine amounts can change periodically.
