Understanding Turkey's Entry Ban for Visa and Legal Stay Violations
09.06.2020
For foreign nationals who violate their legal right to stay in Turkey – encompassing breaches of visa, visa exemption, residence permit, or work permit regulations – entry bans are implemented under Law No. 6458 on Foreigners and International Protection, dated 4/4/2013. Article 9, titled “Entry ban to Turkey,” outlines the principles governing these prohibitions.
The duration of an entry ban is determined by the nature and extent of the violation. Generally, for foreigners who leave the country under specific conditions after violating their legal right to stay, the decision for an entry ban to Turkey can range from 1 month to 5 years.
Conditions Leading to Entry Bans
A key scenario involves foreigners who overstay their permitted duration. Specifically:
Spontaneous Departure with Administrative Fines: For those who have violated their legal right to stay for more than 3 months (including 3 months), and choose to leave Turkey before their situation is officially determined by the competent authorities, they are subject to an entry ban. This ban is imposed upon payment of administrative fines, as stipulated by Fees Law No. 492, when they present themselves at border gates.
Entry Ban Duration for Specific Violations
The duration of the entry ban is directly correlated with the period of violation. For foreigners falling under the scope described above, the corresponding entry ban periods are as follows:
- 1 year – 2 years violation: Results in an entry ban for 1 year (identified by the Ç-102 CODE).
It is crucial for foreign nationals residing in or planning to visit Turkey to be aware of these regulations to ensure compliance and avoid potential entry bans. Understanding the nuances of visa validity, permit extensions, and the consequences of overstaying is paramount for a seamless experience in Turkey.
