Understanding Work Permit Criteria in Turkey

Foreigners wishing to work in Turkey must generally comply with the International Labor Law No. 6735. The Ministry of Labor and Social Security sets specific economic and employment benchmarks for companies hiring foreign staff. Under standard rules, a company must employ at least five Turkish citizens for every one foreign employee. Additionally, the company must have a paid-in capital of at least 100,000 TL.

However, the Turkish government recognizes that certain groups of foreigners should have easier access to the labor market. These individuals are exempt from the standard evaluation criteria, meaning the 5:1 ratio and capital requirements do not apply to their applications.

Foreigners Exempt from Standard Work Permit Criteria

  • Foreigners who have a Turkish citizen parent or child.

Citizenship and Ethnic Background

Turkey provides special labor rights to individuals with historical or ethnic ties to the country. This includes:

  • Blue Card Holders: Former Turkish citizens who lost their citizenship by permission but retain certain rights.
  • Turkish Nobles: Foreigners of Turkish descent who can prove their lineage.
  • TRNC Citizens: Citizens of the Turkish Republic of Northern Cyprus.

International Protection and Humanitarian Status

Specific regulations apply to those residing in Turkey for humanitarian reasons:

  • Syrian Citizens: Foreigners under Temporary Protection status.
  • International Protection: Individuals recognized as refugees or those under conditional protection.

The Application Process for Exempt Individuals

Even if you are exempt from the 5:1 employment ratio, you must still follow the official application steps. The process is conducted electronically through the Ministry of Labor's online portal. The employer must submit the contract, relevant diplomas, and proof of the foreigner's status (such as a marriage certificate or Blue Card).

The Ministry typically processes these applications within 30 days. Once approved, the work permit also serves as a residence permit. Working without a valid permit leads to high administrative fines and potential deportation for the individual, as well as penalties for the employer.
