Understanding the Work Permit Extension Process

Foreigners working in Turkey must maintain a valid work permit to remain legally employed. According to Article 10 of the International Labor Law No. 6735, a work permit is initially issued for a specific period, usually one year. If you plan to continue working, you must apply for an extension before your current permit expires.

The extension process is critical. If you continue to work after your permit expires without a pending extension application, you are working illegally. This can lead to administrative fines and potential deportation for the employee, as well as heavy penalties for the employer.

When to Apply for an Extension

Timing is the most important factor in a successful extension. You must submit your application within the 60 days prior to the expiration date of your current permit. You cannot apply earlier than 60 days before the expiry. Most importantly, you cannot apply once the permit has already expired. If the permit expires, you must start a new initial application process, which is more complex and subject to different criteria.

Duration of Extended Work Permits

The length of the extension depends on whether you stay with the same employer. If you continue working at the same workplace and in the same job:

  • First Extension: Usually granted for a maximum of two years.
  • Subsequent Extensions: Can be granted for up to three years.

If you change employers, the application is treated as a new application rather than a simple extension, and the initial one-year limit typically applies again.

Required Documents for Employers (Home Services)

If the foreigner is employed in a household (e.g., as a caregiver or domestic worker), the employer must provide the following:

  • Identity Documents: A copy of the employer's Turkish ID card.
  • Family Documentation: If the employee is caring for an elderly person, provide the ID card and residence address of the mother or father being cared for.
  • E-Signature: The employer must have a valid electronic signature to submit the application through the Ministry's online system.

Required Documents for Corporate Employers

For limited companies or other legal entities, the documentation requirements are more extensive to prove the business is active and financially stable:

  • Trade Registry Gazette: Documents showing the current shareholding and management structure.
  • Activity Certificate: An up-to-date certificate from the Chamber of Commerce.
  • Tax and Financial Records: The most recent balance sheet and income statement certified by tax authorities.
  • SSI Number: The 26-digit Social Security Institution (SGK) registration number of the business.
  • Mersis Number: The Central Registration System number of the company.
  • E-Signature: An authorized representative of the company must use an electronic signature for the filing.

Required Documents for the Foreign Employee

The foreign national must provide updated personal information to ensure their records are current:

  • Biometric Photos: Two recent biometric photos taken within the last six months.
  • Passport Copy: A clear copy of the passport pages containing the photo, expiration date, and last entry stamp. The passport must be valid for at least 60 days beyond the requested permit duration.
  • Current Work Permit: A copy of the front and back of the existing work permit card.
  • Residence Permit: If applicable, a copy of the current residence permit card.

Step-by-Step Application Guide

The extension process is handled electronically through the e-Permit system managed by the Ministry of Labor and Social Security.

  1. Preparation: Gather all employer and employee documents 60 days before the permit expires.
  2. Online Submission: The employer or an authorized intermediary logs into the system using an e-signature.
  3. Data Entry: Update the foreigner's salary information and job description if necessary. The salary must meet the minimum thresholds set by the Ministry for specific professions.
  4. Payment: Once the application is approved, pay the required work permit fee and card fee.
  5. Card Issuance: The Ministry prints the new card and sends it to the employer's address via PTT (Turkish Post).

Important Considerations and Penalties

The Ministry of Labor may request additional documents at any time during the evaluation. Common reasons for rejection include insufficient financial standing of the employer, failure to pay social security premiums (SGK) for the employee, or paying a salary lower than the legal requirement for that specific role. Always ensure that all SGK payments are up to date before submitting the extension request.
